Terms of Service

Effective date: July 2, 2026

These Terms of Service ("Terms") govern your access to and use of Lexcellent ("Lexcellent", "Service", "we", "us", "our"), operated by Individual Entrepreneur Anton Elizarev, Armenia ("Provider").

By creating an account, using the Service, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Lexcellent is a language learning service that lets users upload texts, analyze them into words, receive translations and related language information, add words to study cards, review words on supported clients, and maintain a personal vocabulary history.

The Service may remember words that you mark as known, learned, or in progress, and may use this information to adjust what is shown to you in future text analysis and review flows.

2. Eligibility

The Service is not intended for children under 16. If you are under the age of majority in your country, you may use the Service only with the consent of a parent or legal guardian.

You are responsible for ensuring that your use of the Service is lawful in your country.

3. Accounts

You may need an account to use some or all features of the Service. You are responsible for keeping your login credentials secure and for all activity under your account.

You must provide accurate account and payment information and keep it up to date.

4. User Content

You may upload texts and other content to the Service ("User Content"). You retain your rights to your User Content.

You grant us a limited permission to store, process, analyze, and display parts of your User Content only as necessary to provide the Service to you.

Lexcellent stores uploaded texts internally. Full uploaded texts are not made public and are not shown to other users. The Service may show short examples from your uploaded texts for individual words, and only to the user account that uploaded the relevant text.

User data is kept separate between users. One user's uploaded texts, vocabulary, progress, and study history are not intentionally shared with other users.

5. Your Responsibility for User Content

You are fully responsible for the texts and other content you upload.

You must not upload content that:

  • infringes copyrights, trademarks, or other rights of third parties;
  • contains unlawful, harmful, abusive, or discriminatory material;
  • contains personal data of other people unless you have the right to process it;
  • violates any applicable law or regulation.

We may remove content or restrict access to the Service if we believe these Terms are being violated.

6. Language Data and Accuracy

Lexcellent may use third-party linguistic and translation resources, including Google Translate, UniMorph, Stanza, spaCy, Wiktextract, and similar datasets or tools.

The Service may provide translations, word forms, pronunciation-related information, examples, explanations, and other language data. This information may be incomplete, inaccurate, outdated, or unsuitable for your specific learning goal.

You are responsible for checking the accuracy of translations, pronunciation, word meanings, grammar, examples, and any other learning materials before relying on them.

Lexcellent does not guarantee that use of the Service will result in learning progress, fluency, memorization, exam results, or any specific language outcome. You choose what to study, how often to review, and how to use the Service.

7. Study Cards and Notifications

The Service may send study cards, reminders, or notifications to supported devices. You control your study settings, including review frequency where available.

You are responsible for configuring notifications in a way that is appropriate for your schedule, attention, safety, and device usage.

8. Subscriptions and Payments

Some features may be free with limits. Free plans may limit the number of words that can be studied at the same time and the number of words stored as known, learned, or remembered.

Paid subscriptions may be offered through Paddle and, in the future, through Apple App Store In-App Purchases, Google Play Billing, or other payment providers.

Payments, billing, renewals, cancellations, and refunds may be handled by the payment provider used for the purchase. Your use of those payment methods may also be subject to the provider's own terms and policies.

9. Refunds

Refunds are handled according to our Refund Policy and, where applicable, the rules of the payment provider, Paddle, Apple App Store, Google Play, or another provider used for the purchase.

10. Acceptable Use

You agree not to:

  • misuse, disrupt, overload, or attempt to gain unauthorized access to the Service;
  • reverse engineer, scrape, or abuse the Service except where allowed by law;
  • use the Service to process illegal content or content you have no right to use;
  • bypass limits, access controls, or payment restrictions;
  • use the Service in a way that harms other users, the Service, or third parties.

11. Intellectual Property

Lexcellent, including its software, interface, design, name, logo, and related materials, is owned by us or our licensors and is protected by applicable intellectual property laws.

These Terms do not transfer ownership of Lexcellent or any related intellectual property to you.

12. Account Deletion

You may request deletion of your account and associated personal data by contacting us at support@lexcellent.app or using any account deletion tools available in the Service.

Some information may be retained where required for legal, tax, security, fraud prevention, dispute resolution, or legitimate business record purposes.

13. Service Changes and Availability

We may modify, suspend, or discontinue parts of the Service at any time. We may also add, remove, or change features, limits, plans, or pricing.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

14. Disclaimer

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of accuracy, fitness for a particular purpose, merchantability, and non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, loss of profits, loss of learning progress, or business interruption.

To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid to us for the Service during the three months before the claim arose, or USD 50 if you did not pay for the Service.

16. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if you violate these Terms, misuse the Service, create legal risk, fail to pay applicable fees, or if we are required to do so by law or a payment provider.

17. Governing Law

These Terms are governed by the laws of the Republic of Armenia, without regard to conflict of law rules.

18. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as by posting the updated Terms in the Service or on our website.

Your continued use of the Service after the updated Terms become effective means you accept the updated Terms.
